Boyda Law LLC, in most personal injury cases, accepts the cases on a contingent fee basis. What this means is that you are not responsible for paying a fee unless a recovery is made in your case, in other words if you don’t get paid we don’t get paid. If a recovery is made, a percentage of the recovery will be paid to the firm. This percentage is agreed upon prior to any signed contract.

Why is a Contingency Fee Beneficial to You?

With this fee arrangement, you will not be responsible for any expense up front. Boyda Law LLC will cover all expenses of the investigation, the deposition costs and for filing the lawsuit, etc. If a recovery is made, expenses are taken out prior to figuring the contingency fee. If no recovery is made, Boyda Law LLC will cover the expenses, and you will not be responsible for them.

Here is an Example of How a Contingency Fee Works for Your Benefit.

The typical fee for services on an hourly billing basis in the Kansas City area is $250.00 an hour. In a personal injury case, no attorney can know how much time and effort will be needed to resolve a claim. In a typical auto case where the other driver states that you also contributed to the accident, an investigation will come into play. In some cases, the other driver’s insurance company may pay for an Accident Reconstructionist to investigate and use equations based on average perception time and other factors to produce an analysis that concludes you were speeding at the time of the accident or some other aspect of the incident that indicates you were somehow at fault. This investigation must be analyzed in depth and the inconsistencies brought out to the insurance company in negotiations and/or to the jury if a trial is necessary. This takes time and expenses mount. One can figure a typical car accident with some allegation of fault on your part will take a lawyer an average of 100 hours of legal research, expert witness consulting and negotiation to try to make a recovery in the case. On a hourly billing basis, the attorney’s fee alone would be $25,000.00. This figure does not include any upfront costs that would come into play such as the costs of consulting with an expert. This figure also does not include the expenses of a trial. If a trial is warranted, expenses can double and even triple depending on the needs of the case.

As you can see, with a contingent fee arrangement, the unknown price of services is removed from the equation. This takes stress off of you, and gives you the ability to concentrate on your health and family.
